A one day conference and workshop for Postgraduate Research Students and Early Career Researchers 
introducing best practice in open research.  The day will introduce concepts and themes around open 
research and the open agenda, provide practical help in engaging with open access to research 
information, and investigate some of the broader topics relating to open access that researchers need 
to consider.   
DISCOVERING OPEN PRACTICES 1 
 
EXERCISE: INTELLECTUAL PROPERTY ISSUES 
This exercise is intended to draw out issues related to intellectual property which often are the main 
obstacle to sharing data. Two scenarios are presented, both drawn from real cases. The scenarios are 
intended to stimulate discussion within the group.  
 
SCENARIO ONE 
A project has collected data from a Thompson-Reuters database of patent registrations. Can the project 
share the data through an archive or repository? If not, the project wonders if the archive.repository is 
able to create a catalogue record with a note indicating the project has collated this data and would be 
willing to share it with others if they were asked. Is this an acceptable compromise? 
Discuss the possible outcomes: 
A) Yes 
B) No 
C) Maybe 
 
SCENARIO TWO 
A project has linguistic corpus data based on an extract of text from one of the Harry Potter books. The 
data consists of the text extract and audio recordings of participants reading the text. 
Can you 
A) Go ahead and share the data? 
B) Go ahead and share it for non-commercial re-use only 
C) Ask for permission from the publisher of Harry Potter to share the data 
D) Ask people who want to reuse the data to get permission from the publisher of Harry Potter.
